We collect and process your data for the execution of our services, including mediation, staffing, secondment, payroll, contracting of freelancers, recruitment & selection, in- and outsourcing, talent management, personal development and employability, reintegration, coaching, assesments, career guidance and outplacement, advice, research, planning and personnel, salary administration and invoicing.

We process the information:

  • To correctly execute the agreement and/or terms and conditions of use that we have agreed with you;
  • To comply with a legal obligation;
  • On the legal basis of a legitimate interest which is in line with the purposes (why do we process personal data), we do this on the basis of a careful assessment and weighing of interests;
  • In limited cases: with your consent, where this is possible and where you are informed and free to give this consent. (If you are younger than 16, we need the consent of your parents (or the person who has parental responsibility).

our use of innovative HR technologies for matching and services

Our ultimate goal is to support people and organizations in realizing their true potential. We believe that the best way to achieve that goal is by combining our passion for people with the power of today’s HR technologies. By HR technologies we mean technologies that help us digitize and enhance a variety of recruitment-related processes. 

For example we use chatbots to improve your experience. Chatbots give candidates the opportunity to answer questions based on the requirements of the job/assignment they apply for or react to.  This is a user-friendly way for candidates to:

  • provide us with relevant information that may not be readily apparent from the application or reaction to an assignment, profile or resume of a candidate;
  • know promptly whether their skills meet a job/assignment’s essential requirements and, if not, to easily explore other jobs/assignments or to identify gaps in their skillset;
  • answer at any moment convenient to the user.

As part of the larger recruitment process, HR technologies allow us to connect candidates more quickly to our consultants.  This, in turn, allows our consultants to better support candidates in exploring jobs/assignments and to deliver the right candidates more quickly to our clients. HR technologies also allow our consultants to find people based not only on the jobs/assignments they qualify for but also on the basis of jobs/assignments they are interested in.

HR technologies help us to search through a broader and more diverse set of candidates so that we become even better at finding the best talent with the most relevant skill-set for our clients. Thanks to these technologies our consultants can focus on the tasks that require genuinely human traits that technology cannot emulate: creativity and emotion. 

web beacons

Our emails may contain a single, campaign-unique "web beacon pixel" to tell us whether our emails are opened and verify any clicks through to links within the email. We may use this information for analytics purposes and make them more efficient, to determine which of our emails are opened and are more interesting to users, to query whether users who do not open our emails, wish to continue receiving them and to inform our advertisers in aggregate how many users have clicked on their advertisements. The pixel will be deleted when you delete the email. If you do not wish the pixel to be downloaded to your device, you should select to receive emails from us in plain text rather than HTML.

responsible use of HR technologies

Yacht is committed to the ethical and responsible use of innovative HR technologies (you can read our AI principles here). Yacht does not use these technologies as a substitute for humans or human interaction in any part of its processes. Instead, our use of HR technologies is intended to make interactions with clients and candidates more personal, relevant and meaningful.

We strive to involve human beings whenever we make decisions that significantly impact you. If, in exceptional cases, we were to make such decisions based on a fully automated process (ie. without involvement of humans), we will only do so where that is permitted by law and after having notified you.

To ensure all candidates are treated fairly we take steps to avoid bias where we use HR technologies. For example:

  • We regularly test the output created by these technologies to identify potential unfair bias;
  • We regularly obtain expert advice to continuously improve the way in which we identify and remove bias;
  • Both our consultants and our search and match algorithms are thoroughly trained and always work together. 

when we collect your personal data

We collect your personal data for example when:

  • You visit our website(s) or use the Yacht app;
  • You fill in or leave your data on our website;
  • You create an account on the website or through the app;
  • You sign up at one of our locations; or
  • You register or are registered in any other way, to use our services or to provide you with a service.

And if we have not received it directly from you;

  • From social media, only if we have a legitimate interest to assume that you would be interested in work. In this case, we will contact you to ask whether you are interested in registering with us or otherwise using our services.  If you are not interested, we may process relevant data to take into account your request not to be contacted by us;
  • If we receive personal (contact) information from reference or emergency contacts provided by you;
  • If clients to whom you have been introduced or where you work or have worked, share personal information about you with us or who register you for our services; if this is part of, or arises from, our agreement;
  • From suppliers in the context of in- and outsourcing, in which case we have agreed with the supplier that they will inform you and refer to our privacy statement.

with whom we can share your personal data

Yacht can share your personal data with the following (categories) of recipients:

  • Companies that are part of the Randstad N.V. group;  
  • Subcontractors and suppliers (such as data processors), who deliver services or execute assignments on behalf of Yacht. These recipients only have access to the data they necessarily need to perform their tasks and are bound by contractual obligations;
  • Third parties such as service providers, who execute positions on our behalf (among them test-, training-, and/or examining bodies, external consultants, parties who do customer satisfaction measurements such as for quality marks and certifications, business partners and professional advisors such as lawyers, auditors, technical support functions and IT consultants who develop and test our systems);
  • Clients to whom we may introduce you or where you will be working through us or who may ask us to use our services for your career counselling, coaching, mediation or outplacement;
  • Private persons and organizations who have information on your references or suitability (such as diplomas) or who provide us with information at your request, such as current, former or intended employers, trainers, examination institutes and employment agencies;
  • Third parties to whom we provide data with your explicit consent or who share data with us at your request in connection with data portability;
  • Pension funds, if applicable;
  • Government agencies and other bodies (such as subsidy applicants) if we believe we are obliged or entitled to do so.

 And in all other cases in which we may be obliged to do so, for example by a court order or a court judgment.

The sharing of personal data is done on the basis of a legitimate interest, consent, legal obligation and/or for the execution of the agreement in accordance with the purposes as stated under "Why do we collect your personal data?".

Your personal data may be transferred or stored outside the Netherlands. Yacht has taken the necessary measures to ensure an adequate protection of the transferred personal data. Your personal data may be sent to one or more countries within or outside the European Union and be processed there. We shall only transfer your personal data to countries outside the EU, if the European Commission is of the opinion that there is an adequate level of protection, or if Yacht or its group companies have taken adequate security measures to guarantee the privacy of your data. You have the right to request:

  • Access to the personal data that we process from you;
  • Rectification of your personal data;
  • Deletion of your personal data or restriction of processing: in certain circumstances, unless we have a good reason, such as a legal obligation, to process or not to delete the personal data;
  • Restriction of or an objection to the processing of personal data;
  • Transfer of your data. 

We will deal with your request with special care to ensure your rights can be exercised effectively. We may ask you for proof of identity to ensure that we are nog sharing your personal data with anyone else but yourself.

We do not use automated decision-making based solely on automated processing, including profiling.

for professionals, consultants, freelancers and clients with a yacht freelance and/or my yacht account:

If you have your own account (Yacht Freelance/My Yacht), you have access to some of your data (such as pay slips and annual statements).

If the processing of your personal data is based on your consent, you also have the right to withdraw your consent at any time. Withdrawing your consent, however, does not affect the lawfulness of any processing based on your previous consent, before we received such a withdrawal, or in case further processing of the same data was done according another basis, such as a contract or legal obligation from Yacht.

  • If you have signed up for receiving information about news-, events-, alerts or other messages, you can unsubscribe for this via the unsubscribe option in the email you receive about this;
  • You can prevent cookies from being placed through your browser settings but you can also change your cookie settings or remove them from your device at any time through the browser settings;
  • If you want to change or delete data that you cannot change yourself, you may contact your HR manager. Yacht is doing everything to protect your personal data in the best possible way. Yacht is ISO 27001 certified. Our organisational and security measures are based upon our Information security policy. We have taken physical, administrative, organizational and technical measures to this end to prevent unlawful use, taking into account the latest state of the art. These measures are regularly evaluated and updated where necessary.

If and insofar data is provided to data processors, who provide services or execute assignments on its behalf, Yacht has agreed with them that they also protect the personal data in the best possible way. 

You should be aware that you are personally responsible for the security of your computer equipment and/or telephone and of your own internet connection, and that this will never be 100% safe. The transmission of personal data through the internet therefore occurs at your own risk. The correct operation and security of the Yacht app is only applicable if the device, on which the Yacht app is installed, is equipped with the official versions of operating systems from Google (Android) and Apple (iOS), which are supported by us.

When deploying camera surveillance, the various interests are carefully weighed, the images are stored for as short a time as possible and removed after any successful submission to the police.

what personal data do we collect from you?

We process personal data that is necessary for our services; some of this data is mandatory in order to use our services. Without this data, we cannot perform our services. Additional data may be desirable in order to better tailor the service to your wishes, qualities or availability or to meet more specific questions or obligations regarding the position and/or from clients. We ask that you only provide us with information that is accurate and relevant.

We may also collect (contact) data from you if you have posted it on public resources only if we have a justified reason to believe that you would be interested in work or our services. In that case, we will contact you to ask whether you are interested in registering with us in accordance with our terms and conditions and subject to this Privacy Statement. You are personally responsible for any personal data that is available from you on/via the internet. Tip: check this regularly and if you do not want information to be available to third parties, protect this properly.  

More specifically, it concerns - among other things - the following (documents with) personal data:

Upon registration;

  • Name, address and other contact details;
  • Birth details, age, gender;
  • Curriculum vitae (CV), information about education, internships and work experience;
  • Details of training and education and/or tests that you have followed or taken yourself or through us;
  • Details on availability and leave;
  • Other information that is (or may be) important in assessing your suitability as a candidate, such as references and testimonials;
  • Passport photo and video (introduction) - on a voluntary basis.

A copy of your ID may be stored and checked during the recruitment and selection process in order to verify whether you are allowed to work in the Netherlands.  If you do not start working for us , your ID will be removed within four weeks.

We are committed to an inclusive labour market, where everyone who can, is allowed to participate.  We request information such as your gender to communicate with you, information about your age to identify you in our systems and to determine whether we have certain obligations (such as relating to wages and whether we need consent from parents or guardians).

At the time you can start working/have worked for Yacht;

  • Nationality, BSN (citizen service number) number, ID, work permit (if applicable);
  • Other data that are related to the personnel-, salary- and absence/leave registration;
  • In addition, for certain positions we sometimes process data in the context of a pre-employment screening.  If you are hired through us to be outsourced to a client;
  • Data necessary for the limitation of the hirer liability (such as NAW (name - address - city), date of birth, citizen service number, kind of ID-card, number and period of validity, if any: residence permit, A1 statement, work permit).
  • In case of a zzp-er also: Chamber of Commerce information, VAT number, company liability insurance information and the, entrepreneurship checklist; We process specific ID data but do not store a copy of the ID document.

Yacht records special personal data only, if this is necessary to comply with its legal obligations, or if this is permitted otherwise by or under the law. "Special personal data" means: data about race or ethnic origin, political views, religion or philosophical belief, genetic and biometric data, health, sexual life, membership union, criminal law personal data and/or personal data about illegal or disruptive behaviour.

We collect and process your data for the execution of our services, including mediation, staffing, secondment, payroll, recruitment & selection, in- and outsourcing, personal development and employability, reintegration, career counselling, coaching and outplacement, planning, personnel and salary administration.

More specifically, your personal data is processed in order to:

  • Communicate with you;
  • Make you offers and/or provide you with information about our services and other activities and to align these better to your wishes and qualities, this is done by our staff and partly automated (e.g. in the case of a vacancy alert or freelance pool);
  • To approach you for commercial offers, newsletters, events and promotional actions that may be of interest to you, this may include job vacancies of Randstad Group Netherlands (internal vacancies);
  • Process data on behalf of events, in which you participate;
  • Connecting you and others, for example through the Yacht community or Connect;

  • To be able to assess your suitability and availability in relation to the mediation of permanent or temporary work or an assignment, which may also include the use of test results, reference checks and social media (only if relevant to the position and indicated in the job advertisement);
  • Gain insight into companies where or through whom you may be employed or how we may support or advise you in your job search;
  • To introduce you to our clients, this can also be done by means of audio and/or visual material, in the case of videos or photos: only if you have provided these to us voluntarily;
  • To schedule you in the best possible way according to your wishes and availability and the possibilities with our client;  
  • To enter into and maintain an employee or staff/employment relationship with you and to carry out the relevant administration for this purpose;
  • Fulfil our reintegration obligations and comply with (government-imposed) targets to help people with a large(r) distance to the labour market find work;
  • To carry out the required actions and administration in the event that we are the owner-risk carrier;
  • To record an assignment with the client in an agreement and to maintain and fulfil the agreement with the client;

  • Promoting your personal development and employability, including through training, education and testing;
  • Guiding your career and helping you with outplacement;
  • For management purposes including: management information, taking care of internal controls and company safety and to carry out audits and accountancy control;
  • Quality purposes such as certification;
  • To be able to claim subsidies, premium discounts, wage costs benefits, etc;
  • If we have entered into an employee or staff/brokerage relationship with you, or agreed on a Model agreement, for compliance with legislation and regulations, including but not limited to identification, labour legislation, tax and social security legislation, pensions, fight against fraud and national and international sanctions legislation.

how long do we keep your personal data?

We determine the retention periods on the basis of laws and regulations and possible claim risks or other obligations, with the basic principle that your personal data is not kept any longer than necessary. For the purposes and target group mentioned above, this is generally a period of two, five or seven years.

This means:

If you haven't worked for yacht (yet)

Your mediation data (CV, work experience, education, test results etc.) are available until two years after the last contact, if you have not worked for Yacht. You receive a message from us, one year after the last contact as well as two years after the last contact, that you are registered with us.

If you do not want to be mediated anymore, you can inform your contact person or adjust your preferences in Yacht Freelance/My Yacht.

Do you want us to delete your account and your data? Please indicate this in My Yacht and/or Yacht Freelance. After we delete your account, you will no longer appear in our active file. We will no longer approach you and stop the mediation from Yacht. Your data is still available for three months in a protected environment for the purpose of claims.and under strict conditions, which are in accordance with the goals and periods set for this. After expiry of these terms, Yacht permanently removes your data.

Please note: if you have not been in contact with Yacht for two years, we will remove your data automatically. We will inform you of this in time. If you do not want your account to be deleted after two years, you can prevent this by, for example, updating your profile or by specifically applying for or responding to an assignment.

If you work/have worked for yacht and you have a my yacht account

Your personal details are available until two years after the end of the employment or assignment.

For example, certain personal data is for claims, audits and fiscal obligations longer available for Yacht.  More information about this can be found in the Terms and Conditions of Use My Yacht for professionals, Yacht Freelance/My Yacht for freelancers or My YEM for freelancers.

If you do not want to be mediated anymore, you can tell your HR manager or you can adjust your preferences. You will not be contacted and mediated by Yacht anymore.
